Court case ,,result.
 
Oh joy of Joys, spent all morning in court today. quick precis as to why.

Sept 06, decided to go to Sainsbury's for petrol after work, two lanes out of supermarket, left lane marked exit, right lane feeder lane to forecourt, both clearly marked, pull up behind 1 car already in lane, car moves to right onto forecourt, pumps free on left so i pull forward to go to one. thump, car comes across me and collects my front wing. WTF. where did he come from, obviously from left exit lane both get out and he says," i was only going for air in tyre and i didn't want to queue". sent details to ins and they decided he was totally at fault after speaking to me and was i prepared to go to court . Absolutely, so today was the day.

Had chat to barrister and in we went, first i was asked if my statement was true,yes, and then asked to expand on layout of entry and forecourt and circumstances, then was questioned by his barrister. made a big play on the queue, there was no queue, and then tried to say i didn't look behind to see if anything was behind me. there wasn't, so why didn't i see him coming up on my left. kept answers simple and then it was time for other driver to give evidence, he tried to say that there were 2 or three cars behind me, Judge then asked him if so then why , as they woukd have had a clear view of the accident they weren't called as witnesses, he declined to answer that one. after quite a few more questions from my barrister the judge said that he was entirely to blame and i was totally not. What a relief after 18 months. His insurers now have to pay all repair costs, car hire, court fees legal fees and my expenses, no wonder he went out looking very sheepish. Have i any sympathy for him, not bloody likely.

Pitty he's not got to pay out of his own pocket, the lying scumbag.

all depends if he had legal cover

he might still have to pick up the legal bill


sorry but insurance companys should have not let it get that far in the first place

I know the layout well - it's the local petrol station. I simply can't understand how the other driver's insurers allowed this to go to court, it was so obvious that the arseh*le was a liar. If you could see the layout it is just so obvious, there could only possibly be one explanation.

So a good outturn:p

I'm still fighting mine from last December because like you the other party is lying to his insurance company. GRRRRRRR

The tossers barrister was obviously struggling to mount a decent defense, he wasn't helped in any way by the judge either, at the end his barrister asked if he could appeal, the judge was almost lost for words at the stupidity of the request, brilliant.
