Some people are so unreasonable
 
Work story about my one divorce case... the Financial Directions Hearing was due to take place in a county court in London tomorrrow. Client however has found the whole thing so stressful and upsetting that he is now a voluntary patient in a psychiatric hospital. Solicitor acting for his ex wife ignored my seven - yes SEVEN - requests for an adjournment so I applied to the Court for an adjournment on an ex parte basis and then served notice of the application on them. It's true that the medical evidence isn't the strongest I've ever seen, but the poor bloke has been in hospital for 2 months now. And I got a fax at 6pm Friday saying that they were opposing the application as there was no reason for it not to go ahead, the mere fact that I haven't been able to take instructions was irrelevant.

Well the Court had looked at it already and the Judge vacated the hearing, so their objection came way too late.

I don't understand why this solicitor on the other side is being such a nasty piece of work. She routinely ignores my letters, never takes my calls, never returns them, and she took a whole year to serve ex-wife's Form E. A whole year!!! And all this on legal aid. There was one excuse after another - too busy, going on holiday, etc. She issued the petition nearly 3 years ago....

It's such an irritation that I can't get a costs order against a legally aided opponent. So in the adjournment application I asked the Court to make aan order against the solicitor personally. Didn't get it, but point was well made.

This is what gives solicitors such a bad name - endless delays, arrogance, and high-handedness. If anyone wants an absolute b*tch as a divorce lawyer, I know a good firm to go to....

Make connection with her face with either of these items in a swinging motion, sit back and laugh at the expression on her face.

Seriously Ed, I know how you feel, we have a company doing the same to us with a divorce and a pension sharing order. Thing is the husband now wants her back so he is delaying things (which he can't do, well he can, but he can't stop them) aswell as the nice kind person at the company afforementioned never answers calls, never calls back and is always on holiday or gone home early.

Yes I have been slapped with a wet Gammon before :rolleyes:

Comes naurally to some peopl I guess or they just work very hard at it.

As a aside, didn't realise people could get legal aid for divorce cases :confused:

I called client on Friday to say I didn't know what would happen - the judge had seen the application but the file was on a trolley someplace between the judge's office and the general office, so they couldn't tell me what the judge had done. I only found out this morning that it was adjourned. So I called him at the hospital only to find that he's had some sort of heart problem over the weekend and is now undergoing tests in the cardiac department:(

Solicitors - 75 quid a letter when I went through my divorce in 1994. Grrrr let it drag out and get more money grrrrrr
