Argh!!!!!!!!!!!!!!!!!!

I was driving my car the other day when some old fool decided that he wanted to be in my lane but couldn't be arsed to look in his mirror. End result, both cars crumpled. The cheeky git is claiming it the other way around and as there are no independent witnesses the insurance want to go 50-50.

Did you stop and take any photos? Would they suffice as evidence if so?

Wouldn't it be obvious what happened from the location of the damage to the cars? Surely if they changed lanes into you without looking in their mirrors and checking the blind spot, their damage will be on the side near the back of the car and yours would be damaged near the front.

If so you could argue that you obviously wouldn't change lanes into a car you can see in front of you.

We were side by side on a roundabout until he moved over. I accelerated to get out of the way (barrier on my left so no escape route) but didnt get passed. Damage is my rear door and his front arch. I was in the left lane to come off the roundabout, he was in the right and moved to left. The annoying thing was that both lanes could exit so he didnt even need to do it!

What is really worrying is that if I'd been on the bike I would most likely of been hurt.

So the idiot drove into the side of you, despite the fact you were clearly visible (must be since he hit your rear door) in front of him! :shock:

I'd contest it saying you want that person to have an eyetest if they can't see a car right next to them....

due to how we in this country go round a roundabout the damage cause equates to more or less a rear ender point that out and tell your insurance that under no circumstances you will accept a 50/50 you'd go to court first, they do that to make life easier for themselves

What a way to exit the roundabout that would have been, swerve back onto it. I just hate the insurances sh*t attitude of making it 50-50 because its easier for them.

Don't let them. They will only be able to make it 50/50 if you let them. Tell them that you will not accept it, contact the Insurance ombudsman (will need to wait 8 weeks to allow the insurance company to change their minds) and get the ball rolling.
You will only have to take a 50/50 if you accept it. Do you have legal cover? If you do, they have to be impartial, so use them and make the insurance company pay out more!

I learned through experience that you can change even the things that are set in stone sometimes if you are willing to fight!
