Speeding offence
 

I have just been getting insurance quotes and I have one speeding offence SP60--3POINTS --£150 FINE the date of the offence is April 2007.
My insurance co. has queeried this as this offence was done away with in 2005 by the M of T due to the ambiguity of the offence

Insurance Co's load you more for this than the standard SP30

Question being ,do I declare it or not, being that it is an offence that did not exist in 2007

Declare it or you won't be insured.

What was it for?
I've got an SP50 that I got on an A road, don't think I would be entitled not to declare it just because it should be an SP30

Difference being that SP30 and SP50 both exist as speeding offenses and are categorized. I was sentenced for of an offense that was no longer in existence and had not been for over two years The old offense of SP60 was used for speeding in roadworks or where a temporary speed limit was in force in most cases.
I was speeding on an A road dual carriageway,70mph limit,most likely a SP30 Offense but not frowned upon to such an extent as SP60 by the insurance,bumping up the premium I'm having to pay.

Contact DVLA and ask them to reclasify it as it is obviously wrong???

I would go so far as to say you shouldnt have been prosecuted in the first place

Thought that but DVLA only do what the courts tell them,they don't have the authority to change a court judgement.

yes but if you have been convicted of an offence which didnt exist, how can you have evidence or convict someone for an offence which doesn't exist?

I am now in contact with the Legal Advisory Team for Essex Courts to get a ruling of what should or shouldn't be.
Typical attitude being "We don't make mistakes like that"

phone dvla ask them have they reclassified it to something else as it doesnt exest any more ,ask if they wish to remove it from your licence, get a written statement from them in reguards to any changes to cover your ar5e

Update-----Letter from Legal Advisory Team
I am correct and sending them my licence to have it changed to SP30. Less loading as most insurance allow you one SP30 before increasing premiums. The court office is also informing the DVLA of the error and getting them to alter their records.
A trivial point but it is making a difference with insurance companies
