Resignation
 
Just wanted a little rant about my current employment situation.



My work have been making unlawful deductions from my salary, I have submitted my resignation with my months notice, as advised by ACAS.

I am sitting here wondering what the hell am I doing.....I know at the end of the month they will make an unlawful deduction from this month’s salary and will force me to take them to an employment tribunal which will be long winded and messy, so why am I sitting here helping them bring more money in by continuing to work for them?

Because you're better than that, than them...

Do it properly and take them to the cleaners legally...

Apart from what you posted I hope you are sorted re getting another job,because you are going to need one.You may win your case in the end and get your money back,and you may get a "constructive dismissal" judgement(eventually)but the payout will be small and you will need to pay the bills in the meantime.

FFS file a claim for unfair dismissal as well - strict 3 month limit applies - on the basis that you were constructively dismissed - ie by resigning you had no choice other than to accept the employer's breach of contract.

Incidentally, did ACAS really advise you to resign???

Yes the advice to resign came from ACAS, they said I could either do that and take them to an employment tribunal or continue to work for them and take them to a county court.

I'm surprised that ACAS advised you to resign. The issue is that you will have no job, and for benefits purposes you will be voluntarily unemployed so you can't claim JSA for 6 weeks. So how do you pay the bills? Remember, success at a Trib is never guaranteed. Have you issued a claim yet? You MUST do it within 3 nmonths of termination. A miss is as good as a mile, 3 months plus oone day is too late.
