Libel?
 
A bit back I bought a car from some robbing chimps, I got it sorted and was happy they got a sting too, so I'm not so fussed about the situation. However, I did a review on a website a little while ago to warn others, it's along side other people's similar (but admittedly less detailed and condemning) reviews - the company have obviously noticed the reviews and everyone's have been removed - I have the option to challenge this but have to submit my name,address etc. and agree to handle any litigation; so the question is....worth it?


I can only see it being a bluff, but I don't really have the time for this sort of **** but would like to see the right thing done.

Any input appreciated

We bought a car from a company in Sheffield and would happily do the same. What websites this you speak of? I would also ask for whap purpose they need your details.

What company was it?

"review centre" I think, they need my name address & proof of purchase to put it back on the site but then I am liable for legal proceedings. Nothing I've said is untrue, I've joined a couple of dots at one point, but put 'probably' in there so I don't think they actually have grounds for libel but you never know...we are mini-USA.

One option is tone it down a bit , and meticulously go over it so there's no chance of a court case or whatever. Bit time consuming, and annoying but an option I guess - would just kick my self if it still caused further hassle after going to that effort.

Or another option is keep joining the site and pasting the review in under different account names. But that seems a bit cowardly to me.

Oh and I've also considered ringing them and asking which bit they disagree with but think that could stir it up a bit much.

One review still stands but the one that's been removed was top google result for their company name for the past few months :(

Edit: no it's been replaced by a 5 star review from a guest explaining how they bought a car and 'all their needs were catered for' 'the warranty was much better than other dealers'

Its only Libel if you post a "fact" that is untrue. and only if they can prove the "fact" that you posted is untrue.

However if you put "I believe..." in front of it, then it is a true fact that you belive it to be so, negating the libel.

you can also use "It is alleged that..." then it is not you that has made the allegation. You are passing on someone elses views.

However, they may then come after you for defamation of character which includes rumours and gossip.

I used to run my own forum so had this stuff regularly.

"I believe" should be safe all round then :)

I've opened with "used them and experienced dishonesty and disregard for customers"
Will I get away with that? It's true!

Can you complain to reviewcentre about the other review as it's obviously posted by the garage themselves?

I say do it, you can always give a false address if you're worried. If you stick to indisputable facts and your opinions then there's no risk, defamation of character does not, AFAIK, include a reasonably held opinion.

It's on one of the other sites that they've put up a good review, I'm just reposting a bad review on that one and I'll try and notify the site.

the reviewcentre one requires a copy of my invoice which has my address on anyway.

exactly, it's a joke - these are the two biggest review sites I could find at a quick google and they just bin of the stuff, one didn't even notify me ...reviewcentre did.
