46mph in 30 speed limit
 
Just got a NIP for 46 mph, doesn't say what speed limit I broke but I'm assuming it was a 30.

Any ideas on the consequences?

Summons: 50 mph

Speed limit: 40 mph
ACPO charging threshold: 46 mph
Summons: 66 mph

Looks like it's a fixed penalty for sure for a 30 and just for a 40...

NIP should tell you where the offence took place so you will be able to find our what the speed limit is. If it is a 30, you will get £60 fine and 3 points, or if it is a first offence (or you have not had a speeding offence for two years), the choice to pay to attend a speed awareness course and avoid the points and fine. If it was in a 40 then it's a bit harsh but will probably result in the same.

I was at a speed awareness course about 18 months ago and one of the delegates had been nicked for 33mph in a 30. I didn't believe him until he showed me the NIP. Seems that they make up the rules to suit.

Couldn't you dispute it in those situations based on the CPS guidelines...does seem kinda harsh!

Either way the OP is paying a small fine and getting 3 points it seems, very unlucky if he was in a 40 but no arguing with the guidelines there...

I was very lucky. The film must have run out, but I went past a camera doing 156'000mph in a 40. Shat myself for about three weeks then relaxed in the knowledge that no NIP was coming my way.

My first ever speeding offence was 57 in a 30 (many years ago) and I was stopped by a traffic car that had been hiding behind a hedge. He told me that I would be reported for the offence and asked where I wanted to produce my documents. I did this and asked in the police station what happens now - they did not know but suggested that as it was a first offence I would probably get a rap on the knuckles and told not to do it again. I didn't hear another word for exactly six months to the day when a summons dropped through my letterbox. I protested to the local police station but pled guilty by post and was fined £75, £25 costs and three points. I have since found out that I could have told them to shove it as there was no NIP and I wasn't cautioned at the roadside.

I was caught in a sneaky way too, just in a 30 before the NSL leaving a village by a radar gun from a lovely chap leaning around a wall, I wasn't so lucky though.....a nice trip to the magistrates for me :) A big lesson learnt that day...my court date was 6 days before Christmas...not a great year
