So I came off today- B**GER
 
Pretty much ok.

Cranked over to the right and I noticed a van pulling out off side street on the left. No probs throttle off a bit and as I got back on the throttle I realise the car behind is pulling out. Hit the horn and aim for the rear end.
Car carried on fof a split second then decided to stop about a third to half way across the lane.

****...., start braking quite hard as I stand the bike up. I was still confident of stopping before hitting the car but I ran over a manhole cover whilst still hard on the brakes and lost it. Darn

Bike still rideable but the lock stop on frame snapped off. Time for filling out forms :roll: and more arguements with the insurance. IIRC , the fact that I didn't hit her doesn't mean she is not liable. Right?

Almost forgotten how much falling off hurts :lol:

She caused an accident, there is good possability to claim.

Sorry to read about it.

I think your right about being able to make a claim against her, BUT you will need witnesses.

You did get some names and addressed - right.

Take care with the painkillers!

Wrong. You dont need witnesses, you need a good lawyer. I won my case filtering with absolutely zero witnesses and no marks on the car to show I hit it.

Ben, did you have a camera phone and take pics of the scene? That will help loads. If not, never mind, just ensure you get yourself a good solicitor. Go back and picture the scene if you havent got any, junction and man hole cover and send that in with the documents.

Its in the highway code about pulling out only when its clear. She entered onto a main road without looking - a good solicitor will be able to work with that.

Bugger... Lynw's right, don't **** about, lawyer up- when it's just a bit dinged it's one thing, but you know what frame damage does to values.

Glad you're OK though, that's always more important. Especially when you've got other bikes ;)
