Hello All,

Yesterday evening about 6pm a friend of mine was traveling home from work when a white van man pulled out of a side street without looking and knocked him off. Luckily it wasn't too bad, apparently he was only travelling at about 20mph at the time, however the usual low speed damage was done (cracked fairing, snaped brake peddle...etc) The van driver was on his mobile at the time :roll:

Now this is where it gets interesting....

The van driver pulled over, got out and walked over... STILL CHATTING AWAY ON HIS MOBILE!!! my mate lost it and smacked him one! he went down (apparently :wink: ) got back up again jumped in his van and drove off! a witness got the van plate, but now where does he stand? He's not too sure about reporting it for obvious reasons but on the flip side he wants his bike fixed and the van driver DID leave the scene of an accident...anyone got any ideas on what he should do here? I'm stumped!

Any advice welcomed....

If your mate has the nerve to follow this up, the Van driver will almost certainly press charges against him for assault, and unfortunately he's perfectly within his rights to do so.

Worse still the van driver can use the same witnesses to give evidence!

Your mate will end up with a criminal record, Van Man probably won't.

If I were your mate I'd keep quiet and put it down to experience. At least he's got a funny story to tell will will be good for a few free pints in the future I'm sure.

I'm fairly certain you can leave the scene of an accident if you are being attacked. Your mate should have done the right thing and kept him down. :wink:

Also if the van man does go to the police, and your mate doesn't. Then he could be in alot of trouble.

I am guessing he didn't get your plate?

I would be content with that i.e smacking him one and not getting the bike fixed. He could probably pick up parts quicker off ebay. :) If I had hit him, I wouldn't say a thing to the insurance company UNLESS you could cross the palm of the witness with silver and get them to say they saw nothing.

Shame your mate got the red mist, as the witness and the phone records would have got white van man for sure. A compensation solicitor would have loved it. As it stands I think it would be better to shut up and pay for you own repairs.

Van man could say "I was trying to report the accident", and then he'd be up a very long creek, with a sunken paddle.... I know that adrenalin may have been on full tap, but he was a bit silly really.....

Best put that one down to experience.

Response to that would be "But we checked your phone records, and you weren't calling any emergency service, but I'm sure your wife would appreciate knowing who you were talking to" (or words to that effect).

As said, keep quiet & fix the minor damage to the bike.

what a dude! i hope he had titanium capped gloves on :twisted: if i was him i'd change my leathers and bike though :? otherwise it 'might' happen again

What the hell isgoing on with those vans? Many recent offs (like kwak zzr's) involve one.
