if the road is "adopted" then the local authority have a duty to maintain it , and therefore would pay any costs for said work, if the road is "unadopted" then its the responsibility of the adjacent property holders, it will probably say something in the property deeds to the effect that you have a resposiblilty, then all the adjacent property holders are supposed to divvy up to pay for its up keep, not any easy thing to arrange, sometimes if its an exceptionally poor condition and dangerous the local authority will carry out repairs and charge individual properties for the same, if it says on your deeds that your resposnible and you dont pay up the authority can recover the costs in court,

if you check with your local highway authority, they should be able to say wether its adopted or not.

if its not, might be just best to throw in a bag of limestone aggregate now and again to fill in the worst of the holes.

Chances are if its not already surfaced then its unlikely to be adopted , but its worth checking.

Does the council collect your wheelie bin from there, if so, blame them for breaking up the surface. Blaming them for the nail would be pushing it a bit. A nice letter perhaps with your neighbours signing it too might do the trick.

Stop drinking and dumping the cans/bottles on the road and use the bin.
