I guess he would. However, put yourself in his place. You loose your wife. would you not be better letting relatives care for your child whilst you fight for justice, rather than attempt to do it from 5000 miles away.

We detain people in prisons, knowing we will eventually kick them out to ensure justice is seen to be done, when it would be a damm sight cheaper to simply kick them out of the UK with a don't come back.

At least give him the right to remain, his child can come back to the UK. Get the upbringing/education etc. That he would have got had somebody not cocked up.
