The cystal plastic protection case that I bought for it had come off and was completely knackered, the front of the Ipod itself was covered in rubber marks from tyres and the back had been somewhat compressed and scratched but the little gem still works perfectly.
I have now bent the back case so that it roughly fits and wiped off the rubber marks (the front looks brand new still) and all is well. Overall it is a tough little cookie and I am well impressed!

Bend the case back where it was and take a video of the Ipod working.
Send video to Apple with a polite letter describing the circumstances and suggest that they might like to have it back to publicise how tough the Ipod is - in return for a replacment one for you?
