Yes. I served the papers last night at 6.45. As there is a Power of Arrest, the injunction has to be served personally (Part 6, Civil Procedure Rules!!!). Normally I'd get a process server to do it but as I was going to be out today (I'm in Liverpool) and as it was late by the time the Court had the sealed Order ready for collection (with the application papers you have to include a draft of the order you want, and at the hearing the District Judge amends it in manuscript if s/he doesn't like what you've asked for, and then you give the amended order to the Court office for them to type up and plonk the seal on - takes a bit of time) there wasn't time to arrange a server. So I decided to do it myself as until someone has been served, you can't complain if they do things in breach
I parked up as close to the front door of the block of flats as I could. I knew he was in cos his car - the one he had given details of in one of his letters - was in the parking area. Went into the communal hall, it's a ground floor flat. Smell of cooking. No spyglass in the door - good. Rang bell. After 30 seconds, sound of a door chain and a bolt being pulled. Man pokes his head round the door.
Me - 'Mr XXXXXXX?' (I'd met him once before so I knew it was him, although he has shaved his head since)
He - 'yes'
Me - Passed the package with the court papers in it to him - if someone passes something to you it's instinctive to open your hand - and he took the envelope. 'I am serving an injunction of the Shrewsbury County Court on you.' I so wanted to say 'bloody well back off and and stop writing f*cking offensive claptrap' but that wouldn't have been professional
He - white as a sheet, jaw dropped, eyes like saucers, I could see the package shaking in his hand - he didn't say anything. He stood there, staring at the envelope in his hand. The penny dropped. Face was a picture. Wish I could have photo'd it.
I walked out, hopped in the car and drove off before he could run after me with a carving knife.
I hope he had a sleepless night. We don't go back to court until mid July - he will have to explain his conduct at the hearing - so there's plenty of time for the ahole to reflect and worry about the damages claim I included also
