Default Warranty on computer components

Need some advice regarding warranties and I’m hoping someone here can help me out a bit, as every bit of information I see regarding the company warranties on this specific product and the Sale of Goods Act seems to be the complete opposite of what’s actually happening.

Six(ish) months ago I purchased a shiny new XFX ATI HD 5850 until it went all screwy. After testing in various other mobos lead to the fact that my new toy was busted and, oh joy, time to start the RMA process.

Direct from the company website:

“In the unlikely event of your card failing within 2 years, ScumbagsRUs will replace your card with a brand new one, pending testing within our standard RMA terms and conditions.”

To me that implies that the company will test and replace the faulty product once it has been deemed to be faulty by THEM not the manufacturer (the company confirmed to me it was broken 20 days ago). So why do I have to wait for the company to get a replacement from the manufacturer when they also confirmed to me they have that product in stock? Isn’t that the opposite of what is stated in my warranty above?

Also, the Sale of Goods Act:

“It is the seller, not the manufacturer, who is responsible if goods do not conform to contract.”

I understand why the company wants to ensure they get a replacement so they are not out of pocket, but TBH that’s not my problem! They provided the product, and according to the Sale of Goods, I have to deal with them and the manufacturer does not enter into it?

Does the above sound right, or am I missing something?
