a cat B must NOT go back on the road according to DVLA. surely this is now the responsibility of the insurers? doesn't answer your question, but in my case where my bike was a cat D write off, they offered compensation and would take the bike away. I opted to keep it, but the offer to remove without charge etc was available.
what does your solicitor advise?
