In your shoes, I would be making similar requests but I have no idea of the legal standings!
Intermittant faults can be hugely frustrating for you and the shop who probably bought the bike in good faith. A similar fault on a friend's bike turned out to be a dodgy wiring loom that took ages to track down. Best of luck sorting this out!
