Rented 5 DVDs and they said that they were returnd 4 days late and want £25.00. The problem is that the i cant remember when the DVDs were returned(i thought they were returned on the correct day)
When the blockbuster account was set up they never explained or gave me any information on late fees. Do i legally have to pay them if they never provided information on late fee charges? They only cost £10 or so to rent for 5 days so £25 for returning them 4 days late seems a bit harsh. Pretty sure they were renturned when on the correct day but cant proove it. mmmmmmmmmm........ ![]() |

Can they prove they were late?
I imagine you'll probably lose your membership if you argue and don't pay. |

Tell them to prove that they were late! I think you would know if you had rented them for 5 days...and kept them for 9!

Say you gave them back on time, and it's up to them to prove you handed them back late, and not that they were processed late. Also explain that it is an unreasonable fine anyway, as it would have cost you less than that to hire them again. Point out that if they can prove you handed them back late, then all you have done is breach a contract, and all they can rightfully claim, is the money you did them out of by handing them back late. This would be the ten pounds for a further 5 days rental.

I've had similar trouble with them in the past - I knew 100% I had returned the DVDs in time, and contested it at the counter. Turns out that their systems were saying the correct dates that I had taken out and returned the DVDs, and this was within the 3 day rental. BUT the system also said (incorrectly) that they were late.
It took 15 mins of getting the counter staff to understand that 'computer says wrong' before they got a manager to override the fine. So got that one overturned, but I know Mr FF has had fines in the past when he thought he shouldn't have done (just didn't think to contest at the time), so I think their system is a bit screwy. |

on a little side note to this..
why not try blockbuster online. i have been using them for about a year, i got the 2 discs at a time deal and itrs ace. i watch one and send it back they send another one out 2 days later. the best i have had is 6 discs in 1 week. there is no late fees and any post box will do for sending them back.. the service i have had is second to none unlike its competitors. at £12 something a month its a bargain. |

My local Bollokbuster fined me for returning a DVD 2 days late, I found this out when I took it into the shop to return it because it didn't work! Yes, that's right, they made me pay for it up front, refused to compensate me when I returned it with another, and then fined me 'cos it was late....How can they fine you for keeping something that didn't work anyway?
I think they're a franchise though, the rules are not written in stone. I took my business elsewhere and they couldn't be better. If I'm late, they just tell me to choose some more films and they'll rent them to me for nothing up to the cost of the fine. Works for me.. |
