Default What would you do?

I ordered a new exhaust on Sunday 22nd of June from a UK seller stating 7 - 10 day delivery.

An exhaust arrived on the 1st July (from the states )but it was the wrong one. I sent it back to the UK address and the cost of doing so was refunded when they recieved it.

A new one was apparently sent out when I notified them and its still not here, they also seem unwilling to give out the shipping company and tracking number stating 'they will track it and let me know'

So far they have been saying it will be here everyday since friday last week......and clearly its not come and frankly I'm getting abit sick of it as I took my bike to bits when I recieved the last one, so its sat there in parts with me slowly forgeting how to put it back together.

Now I know they can send exhausts, because they sent the wrong one initialy, and I know someone that has recieved the right one in the past from them.

How long would you leave it before getting worried and contacting paypal/credit card companies to reverse the transaction?

I have been really patient up until now and even they have been gratefull for my patience but it is wearing thin as the 21 day/ 3 week marker approaches.

Yours stressed and demotivated.

If I were you, I'd read up on the Distance Selling regulations.

Then I'd call the seller, and be firm but polite. You want your exhaust delivered by a date of your choosing - not theirs, otherwise you want a full refund.

Whatever they agree to on the phone, get the name of the person you spoke to and follow it up in writing.

is this one of the "we ship to our location in the UK first" deals?

chances are they got stung for the duty this time and parcelforce are holding it up, i bet normally they just send it to someone in the UK marked as a gift and hope they get away with it...

If its not here by 12 today, I'm going to email them again asking for the shipping company and tracking number. Then state if they cant give me those details and its not here by friday 5pm then I will be seeking a full refund.

Will see how that goes, I have contacted another person who bought at the same time as me 22nd June and they havnt recieved even a wrong one yet......so they are even more worried than I'm.

No it was shipped directly to me.....however it was marked Warranty replacement and undervalued in the description lol

no, they won't, but as the recipient you'll get the letter asking for duty, vat and a handling (read rip off) charge

you didn't get one the first time because they either let it through without checking or believed it was a genuine warranty part, if there's an invoice in the box they have the authority to open them and see what you paid, if it isn't about the same as what they've valued the cutoms decleration as the seller will probably be in trouble for mis-representing the box, but afaik you'll be liable for the appropriate duty/vat etc

of course it may just be the seller dragging their heels, out of stock etc etc, but you should be prepared just in case, i think i was charged about £90 on £300 of stuff when i ordered, still much cheaper than the UK

There is no invoice in the boxes, even if they opened it they would be none the wiser as to what it is as the box states warranty replacement and they undervalue the item so customs would have no idea. Theres no other information on it for them to go on. They seem to have a good setup for now.

Plus I would refuse to except the item for the shipment curior if they wanted further payment, I would tell them to return it to sender and there must be a mistake, and then just claim a refund on my credit card/paypal through payment protection due to false advertising/fraud etc lol.

I've done my background research with the relevant people in the know who all seem to think I'm safe and told me what to do if it backfires.

I was carefull before going through with it in the first place.

So you received the wrong one 8 days ago - then notified them and sent it back to them. Presumably they wouldn't have received this back until about 6 days ago (Thursday?), at which point they may initiate a new order for the right one. So the replacement may have been sent out on Monday at best

I don't see the problem? It's still within the 7-10 days insn't it?

Maybe I'm reading it wrong?!
