Default Restriction questions.

hi all i am currently still in my two year restriction period, i have bought a restrictedcdi with a certificate 2nd hand and fitted it. the certificate has the previous owner of the cdi's registartion on it etc. i have been on the phone to my suzuki dealer and they said that i would have to buy a brand new cdi with a new certificate. is this correct? or would a garage just be able to verify that i have a 33bhp cdi on my bike and reprint a certificate with my details?

If you want a more detailed answer do a search but in summary if I was you I wouldn't bother as there is actually no legal requirement to hold a valid certificate of restriction. The law only stipulates that the bike is actually restricted.

ok thanks for the reply shall be looking that up, i previously had a accident on my old nc29 and i was required to show my registration certificate with my documents at the police station, i was maybe thinking about the fella on ebay selling the certificate's has anyone used him before?

I considered that, but then figured that's pretty much fraud, whereas, as Dave numbers says, it's not a requirement by law.

The certificate is asked for by some insurance companies, however, as the restrictor kit can easily be removed, this makes the piece of paper pretty much useless. Insurance companies are more likely to check for restriction in the event of an accident - rather than for a piece of paper that says the bike was when your policy started.

If you ride without restrictor kit fitted, essentially you're riding outside the limitations of your license, therefore invalidating your policy, yada, yada.

Isn't it more the case that they have to prove it was de-restricted if you have a bad off?

Insurance company never even asked if I was restricted...

Is there a serial number on the CDI which matches that on the certificate? If so, this does indicate that the restriction kit is linked to your bike. You could also back it up with a dynograph.

In short, I wouldn't bother doing anything. If you, hopefully not, have an accident then your insurance company may test your bike but there is no legal requirement for a certificate proving restriction therefore there is no reason to buy one from ebay.

just get the Cert it makes life alot easier . if they will send you a new one for free or for a small fee then i would definatly get it .

Im on 33 BHP and i would only have to show proof in the event of a claim ..
i dont have any proof as i fitted my ECU my self .
People saying they will test your bike ect ect .... its for you to prove to them your bike is resticted not for them to prove to you .

and also what if mybike was stolen ??

No one would be able to test the bike to see if its resticted and if i havent got any documentation saying my bikes resticted they might tell me to F off .

so if i was you i would just get it just makes life easier .

And your legal knowledge on this comes from where?

I can assure, you, if you have an accident, as there is no legal requirement for a certificate the insurance would test the bike if they wanted confirmation. And if it was a really serious accident, then the Police probably would have VOSA examin the bike and they would document the restrictor.

Providing you insurance company does not state it requires a certificate then don't waste your money.
