Default Been offered a crash damaged SV thou near Bristol?

Copied from another forum, sounds like an extremely bad day...

Quote:
well I had a great day yesterday....On my way to work I was hit off my brand new SV1000 (i've had it 2 weeks, some of you might remember me posting pics of it the other week) at a roundabout I was turning right and the plank coming straight onto the roundabout opposite, pulled out and hit me side on completely T-boned me!! Crushed my leg between his car and my bike, I got the full sweet ambulance, emergency car, police lots of blue flashy stuff and was carted off to A&E. Luckily after havin my leg x-rayed it doesnt appear to be broken but my foot is focking killing me and very swollen, doc says there may be small fractures somewhere but nothing major. While this was all happening the police, god bless the long arm of the law, were dragging my BRAND NEW ONLY HAD FOR 2 WEEKS bike out of the road and left it on the pavement, as they wouldn't recover it??!!!

So I gimp out of hospital on crutches luckily my girlfriend picked me up and was driving me around, so we went back to the roundabout to check on my bike....alas to find it not there?! Hmmm I think to myself I wonder what could have possibly have happened to a beautiful unlocked, unalarmed, unattended V-twin with only 10k on the clock and thousands of pounds of mods done to it?! Ofcourse some pikey has half inched it!!!!!! I ring the attending officer back and was like wtf where did u leave it? They kindly came back and said "right here but its not here now so you'll need to report it stolen"....BRILLIANT!

So I cant walk, i'm on crutches, cant work and have NO bike!! This is one hell of an insurance mess! and fk me i'm not a happy bunny! BRAND NEW BIKE!!!

I'd love any serving coppers on here to tell me why they weren't allowed to recover my bike? The cop asked if I would like it recovered as I was being wheeled into the ambulance, I said yes, he said it'd cost around £100, I said fine, he then came back and said ive just been told we're not allowed to recover it, so we've left it on the pavement?!!!

I'm just sooo gutted right now! Where it was left was a nice part of Bristol as well, and on a corner of a busy mini roundabout! And before any1 ask's I have checked all the local recovery groups, council and police to double check it's not been towed. This will be interesting to see how the insurance company handle this, i'm 100% in the clear though, the copper said the driver might be done for driving without due care an attention!

So please if anyone see's an SV that USED to look like this for sale, please let me know...

I'll update with the reg number if I get it...

So this cage-warrior knocks you off your bike. Are the boys in blue taking any action against him?
If so, your loss directly relates to the accident and as such claim for the bike ( and your injuries ) from him.

I suspect the other insurer would claim that, despite the OP being injured and taken off in a meat wagon, he was negligent in leaving it on the side of the road

Good Grief *face palm*
I'm sure you have a damn good case for full payback + damages, fight it if they give you trouble and good luck, let us know how it goes!
Just make sure if the 3rd party company do fight it you track EVERY SINGLE problem caused by being without you bike and add the associated costs/compensation to the case so it grows the longer they take.

I can't honestly imagine if this goes all the way to court, any court in the land would side with an insurance company trying to wash it's hands of responsibility when you were carted off and could do nothing about it.
They can't seriously suggest you decline medical assistance and risk serious damage/death just so they can reduce their insurance risk/liability.
(even if you felt fine at the time you NEED to be checked out ASAP as lots of nasty things can go un-noticed in the initial adrenaline surged moments)
Your own health is your first priority, the rest is their problem.

The police agreed to recovery+price then changed their minds while you were already tucked up in a meat wagon and in no condition to do anything about it but you went straight back as soon as you could.

LOL

OP update, bike was recovered, police forgot about it
Quote:
welllllll...after a crazy turn of events the guy that hit me actually just called me (police gave him my number which was odd asi didnt have his) and I told him the bike had been stolen, he then said no I saw recovery truck taking it away?! I was like WHAT?? So called the recovery company AGAIN and they now have said ye were waiting for you to get in touch!!! HOW CAN I GET IN TOUCH IF THE POLICE TOLD ME IT WASNT RECOVERED!!!! Omfg! But anyway light at the end of the tunnel, by some miracle the bike was recovered yet the attending officers knew nothings of this and didnt ask for it to be recovered? Anyway bike found, me now a tad happier!

To further sully the police's name apparently the offiers advised the car driver to call me and sort the damage out ourselves without insurance!!!! Are the legally allowed to say that??? I think the cop who attended the scene musta slept through his entire road traffic accident training! But I told the car driver no chance i've already informed my insurance! He's getting screwed!
