Well I have just found out my 18 year old nephew has just been nicked for drink/driving.

Well, I have no sympathy for him. But my poor brother and his wife. They thought the sun shone out of his ****, bought him his car, insured it etc.

The daft thing is his mate was done last year taking him for a burger, so he knows the score.

so that's his job gone as well as he cannot get there by public transport. Uni is looking screwed as well unless he can refinance things to get digs instead of commuting.

I wouldn't mind I told him the other day about drinking before he went to work.

I thought kids were supposed to be intelligent.

So if I understand things, because he does not acquire points but straight into a ban, will he get his licence back after a ban, or does he revert to learner as well.

Sounds like he's well and truely buggered things up for himself. I can't understand why he cannot use public transport to get to work or uni though? IME it's often just as quick as using the car. (Bike's a diff matter though , used to get to uni about 20 mins earlier on the bike than car even though I only live around 13 miles from uni)

Woops. I think it will be a retest and may even be the extended one. I do pitty his parents, its going to be difficult for them!

As to youngsters being intelligent... nope, infact im pretty certain in 80% of cases its the other way round, that they are stupid! I work in a college and man, some of the stuff, its just amazing, makes you wonder how the human race got this far tbh!!!

Keep us upto date, its always interesting to hear about people's stupidity... sorry its kinda happened to you!

The licence issue will depend on what the magistrate said on conviction.

Some will insist on a re-test if the driver had a bad crash and was at fault through being drunk, or for failing to stop and being pursued.

If none of the above apply, then after the term of the disqualification, the lad will have to apply to the DVLA for his licence to be re-instated. If he doesn't, he'll effectively have no licence and will be liable to having any new car seized Sec.165 RTA.

Did he get the offer of the Alchohol Awareness Course which reduces the term of the disqualification upon completion?

He will get his license back after his ban is up, plus he might get his ban reduced if he has been offered a drink drive course to do. If he was done for dangerous driving as well though the situation might be different.

I lost my license due to point accumulation whoops. Had to retake my test as it was within the first two years when I lost it (6 points aint much to play with) I thought if it was drink related or dangerous driving you had to take the extended retest? Is that at magistrates discretion then Pete? Having been a teenager and made my share of stupid descisions, I think its just the 'it wont happen to me' syndrome in the main part. hopefully thats a lesson learnt for him and at least nobody was hurt (I hope?)

Ok I have done both, lost my license in the first two years for getting more than 6 points, and for losing it for drink driving. Didn't have to take an extended test or anything, did the course and the ban was reduced by 25%.

Not got before the beak yet. No accident, he got pulled, so his driving must have been below par to tweek the cops radar. then again a young lad, 3:30 in the morning isn't going to get the antennae twitching in the first place.

His place of work is about 9 miles from home. but being bar work in a club, there is no bus services locally after 10 pm and where he works would mean 3 buses and about 16 miles. Uni is a least accessible for him by public transport but unaffordable for an unemployed student.
