Default Removing from joint mortgage

I am still on the mortgage with the ex wife, we got divorced 9 years ago and at the time the judge ordered as per her wishes that she be able to remain responsible in the house, she is classed as disabled and as he was not sure she would be able to get a council place he granted her wish, so she came to an arrangement with the mortgage coy (abbey national) to pay x amount per month, she is on benefits and they pay the interest i believe, and she pays a small amount out of her benefit as well. The judge ordered that my wife was to try and get me removed from it within a couple of months, problem is they won't take me off it, i haven't payed a penny on this for 9 years, but it obviously affects my credit rating as it shows an extra 100k in my name Is there any thing I can do about it, or do I have to go down the taking them to court IE expensive route, there is about 80-100k equity in the house with a 65 35 split in her favor of course any advice gratefully received peeps PS, I was informed the other day that I could demand that the house be sold?

Do you still have the settlement papers?

Best bet is to speak to one of the Org's Lawyers, as to my knowledge (sketchy) Abby/ Santander are in breach of a court judgement by not removing you

Yeah I still have the court order, to my recollection, the words were, she was to use her best efforts, but it's not up to her, or the judge, it's up to the mortgage coy, who are being cnuts.

I removed my ex partner off my mortgage a few years back, but only after a lot of argy bargy.

I couldn't remove him immediately as I didn't satisfy their level of income to take over the mortgage on my own, even though he didn't pay a penny towards it. He had his name there, so was responsible as he had a higher income.

However, as soon as I satisfied their needs, I remortgaged and got rid....

Is this perhaps why they won't allow you to remove your name?

They won't budge then in that case, well not in my experience anyway.

As far as demanding the house be sold, I couldn't answer for your particular scenario, but it wasn't possible for my ex partner to do so, due to having children in the home.

Not your fault dizz, my scanner won't work, I did scan it using windows picture thingy, but it's saved as a picture file obviously so can't delete bit's i don't want people to see, will have to re-load the printer software, takes bleedin ages will give her solicitors a call tommorow see what they say, but don't have much, well any hope.

I'm not the only one to have been in the mortgage tussle with ex partners.
My friend had similar experience too. She kicked her ex out of her house, and tried to get him off her mortgage. She couldn't because of her income either, BUT, the cheeky ex threatened with filing for bankruptcy to wriggle out of responsibility....which blows all things above out of the water.....as the bank could kick her out and her kids, even though she was paying the mortgage, as the house was an asset of her ex partners, and he never paid a penny after he left!
