Default biker down - a2 this morning

it was me.

filtering between lanes 2 and 3 approx 20 - 30 mph, stationary traffic. passenger in freelander in lane 3 opens her door into my path. i had knowhere to go but up.

me - two broken fingers and a broken shoulder blade hurts like hell.

bike - i reckon a write off.

ride safe people

may have some pics if a witness sticks to his promise

Sounds nasty mate - as bad as the injurys are, they could have been worse.

How do you stand on the liability front ?

no idea mate it seems pretty clear cut to me... but who knows?

i thought it was deliberate. apparently she wanted to check on the kids in the back and thought getting out on the third lane of the a2 was the best way to do it

Bad news.Get good legal advice ASAP on this.White Dalton gets a lot of nods on here.I had exactly the same thing happen on the M1 a couple of years ago when some one decided to empty their ashtray.I avoided the door but often wondered what the liability outcome would be.

I think from a legal stance you could well be attributed some of the blame - by filtering at such a high speed you would be opening yourself up to driving without due care and attention. 20-30 mph between traffic is asking for trouble!

the legal basis for blaming the motorcyclist was based on a case in the 60s, since then the law has changed considerably and my case last year was case in point that filtering does not automatically lead you to any blame whatsoever even at 20mph.

and you dont know the road, and bikes frequently filter faster than that. 20mph is within the recommended limit, and its what Im generally doing through that traffic. though tbh Im looking for drivers pulling out and always prepared to stop.

a passenger opening a door on the other hand in lane 3 of traffic is not something you could reasonably expect. and I bet there had been bikes go through in front of svpilot - anyone in that traffic in the morning cant miss the bikes unless it was a. deliberate or b. the person is just so humungously stupid it defies belief.

regardless of him filtering, fault is attributable to passenger/driver of the car.

svpilot, hope you heal quickly. get good legal help and dont take any blame for it. hope the insurers sort the bike out quickly too.

Can't beleive someone would open their door in the 3rd lane of the motorway!
