Default Intransigence of Ermax UK!!

I have just come off the phone with Neil of Ermax UK.
In June this year, my lad bought me a hugger for my SV650S K4 as a present. I fitted it and there was a gap all the way round.
In Sept this year when I took it off there was distinct rubbing where the toolbox was meeting the hugger. So I contacted Ermax and was told by a salesperson that in June this year (and this is the reason for posting) there were TWO different specs of hugger for the SV650S K4 with the SAME part number

Having established that there was a distinct possibility that the wrong spec had been supplied, I spoke with the Neil, the Ermax manager this morning and requested a replacement hugger or my lad's money back.
He categorically stated that "Ermax parts do not come with any warranty" and that I should have checked "over a period of time" that it wasn't rubbing. He did offer to supply another hugger at a discount, but that is not what I believe was due to me.
So "CAVEAT EMPTOR" (let the buyer beware),
Ermax do not supply warranty on their products

Speak to your local CAB or trading standards. I'm sure that can't be right!!!

Don't goods and services need to be "of merchantable quality" or something like that to be legal in this country?Sounds like your hugger may have failed that test.

As Scoobs says, CAB and Trading Standards should be able to help.

Also, when in June did you get it? You might need to act quickly:

i have jus spoken to neil at ermax uk about my tail tidy refund and i sent them a e-mail 3 weeks ago and they never recived it so i sent it again,

i am going to phone them yet again on monday probally post them pic's and if they still dont get them i will see them in the small claims court

i'm dont know exactly but i'm sure that goods have to be fit for there stated purpose, which your hugger isn't

did u mention there legal responibities to them
