Default Housemate Problems - What would YOU do?

Ok lads (and lasses) need something confirming to me.

The situation:

My house mate is signed into a 6 month Assured Shorthold Tennancy Agreement with me down as the landlord.

He works in a pub and earns £200 a week.

Just after christmas he slipped on ice (whilst ****ed out of his head) and damaged his arm (didnt break it, just sprained). And as such was signed off work by the Hospital until the 23rd January.

He was told that he could submit forms for his SSP and other benefits (rent, bills etc) to be paid on benefits. He has only today done this, even though ive been telling him to for weeks, and the council say its going to be 10 weeks before it comes through.

He insists that he has got no money spare, but yet hes out every night, getting smashed, clubbing, shagging around.

He is now 2 months behind in rent, but ive been giving him the benefit of the doubt, until i realised that he did have money as was getting taxi's everywhere, and was partying every night.

Ive told him today that he has until friday to clear his rent arrears (or at least 1 months of it). If he doesnt, im giving him the contractual one months notice of eviction. But he still needs to pay me:

a) the arrears of his rent
b) the months notice rent
c) his share of the bills for the last quarter as per the contract

So, i want to ask:

What would you have done in this situation? Have i acted fairly? Or do you think i have been a bit harsh?

Comments/advice/suggestions welcome please.

I am have been in this situation many times as I am also a resident Landlord.

It's quite clear he's taking you for ride so I'd put an end to it straight away. Give the standard notice of termination on tenancy as he appears to of broken the tenancy agreement. ( Provided in this you have specified he must pay rent )

Hopefully you will of taken a deposit as well which should cover any rent arrears or unpaid bills, although you must supply him with the receipts for this.

I also read somewhere that you can obtain certain items as payment, but this is a very grey area so read up on any literature.

To help your situation resident Landlords have much more rights than non-resident so the law will be on your side.

Hope you manage to sort it, its no fun people taking the p***.

Sounds fair to me, looks like he's been taking the pi$$. I've always had the belief that if you can afford to go partying you can afford to pay your bills. Get fed up with the people I work with moaning they're not paid enough then in the same breath saying they've been out clubbing everynight that week.

Your mate is a selfish sh*t,no question. Ultimatum to cough up or get out. I would also consider feeding him to an angry and ravenous pig!

Once people detect weakness they generally milk it as much as poss. I'd put the relevant process in hand if I were you.

As others have said he's taking the pee pee mate.
Worst part is that the DSS or whoever will only pay him from the time he went to them and are very unlikely to back date it unless the guy was in a coma and couldnt make it. Anything short of that they dont wanna hear. Also they only pay a proportion of his rent, not all.

So even if you did keep this joker on in the hope your total owed would show up....it prolly wouldnt.
Cut your losses and get the git out. He's only gonna be more trouble in the longer run.

Make sure you do it all according to the letter of the law tho. As tempting as it may get to just pack his bags and sling em out one day DONT DO IT cos it'll make life very hard for you from there.

Good luck with it tho.

Ah! Housemate said that the council told him that the full wack would be covered and it would be back dated. TBH i beleive you over him given the lies hes spun so far.

Your housemate, hes taking you for a ride and needs to be booted out. I'd try and fleece him for as much money as you can also.

I think you did the only thing that can be done. It's not nice to have the p*** taken out of you by a lodger/flatmate. I have been there too and threw them out in a less polite way thanyou have done. keep cool and do it right mate.

FWIW give him the red card Joe , he has taken you for a ride. there is no need to take the **** in this way at all. he has poo pooed in his own bed by doing the dirty, so it's time for you to wash the laundry and throw him out .
