Default Insurance claim - Is this right?

I'm hoping someone might be able to help with this.

A friends car got stolen whilst she was indoors. She heard the sound of the car being started, lookd out of the window and gave chase on foot as they thieves drove off.

The theft was then immediately reported to the police and less than two hours later the car was spotted by the police and whilst trying to get away the thieves crashed into another car and made away on foot.

Now the question. Even though the car car was reported stolen and the owner was obviously not the driver, her insurance company has imformed her that the other party which the thieves had crashed into has a right to claim against her policy. This will mean the loss of her no claims bonus etc.

Surely that is not correct. Friend is insured with the RAC.

Afraid so, harsh as it may seem. If the offenders were caught, then your insurance co. sues them.

And the car thieves will sue your firned for any injuries recieved after crashing the car....Its a great nation we live in init

Thanks BluePete. That is very harsh and bordering on 'unfair' to say the least IMO. I know life is not fair but jeez

Well from what I'm just learnt, I won't be surprised if they scums indeed have the right to do that

I guess the logic (if any ) goes that she shouldn't have let her car get stolen.

Plus looking at it from the other point of view, if I was crashed into I'd much rather have someone's insurance to claim off, than claim of the robbers.

Bromley eh, This used to be an affluent commuter belt town when I was younger. Very nice it was too....................I'm afraid its a bit of a sh*t hole now...............to say the least.
