We got a declaration of trust for buying our house. It seems VERY VERY strange that you were even asked to get another solicitor to look at it. We were never prompted for such.

Ours basically just says that should the house be sold, for any reason, all monies owed are to be paid to respective parties (ie mortgage company) then suplus monies devided amognst those named on the mortgage. Jen is however listed as being a party to which money is owed, since her mum gave us the 40k deposit as a "gift," and therefore if the house is sold, that 40k (or whatever % of the sale that would then amount to) goes to Jen. Both me & Jen are named on the mortgage.

So, we bought the house for 160k. 40k of that was deposit (25%). Lets assume the outstanding mortage balance is 160k when we sell the house, and the house sells for 200k. 160k goes to the mortgage company, leaving 40k. 25% of that goes to Jen, leaving 30k in the pot. That's then legally shared between both me & Jen since we have seperate bank accounts. 15k each. Jen actually gets her 10k plus 15k, making 25k.

It's written in simple enough legalese that I can understand ours perfectly well. We never needed (nor was it suggested) that we get someone else to check the solicitors workings.

Girlfriend and I got a Declaration of Trust for our recent house purchase, wasn't asked to get it checked by another solicitor, just check it ourselves, which seemed fair enough as all it says is that X% is mine and Y% is hers.

But then again our solicitor did not witness any of the purchase documents being signed, any old person would do for that so we got our local publican to sign 'em. Whats the advantage of getting the solicitor to witness?

As for some solicitors doing weird things, the solicitor of the bloke who bought my old house sent us a declaration we had to sign regarding planning permissions, we signed it and sent it back. Then he decided he didn't like what he'd written in the first place and rejected it. We told him to feck off.
