Default Court Result.

Further to some pm's from people asking for an update on my circumstances we were in court today.

Having gone not guilty to 2 charges of assault and 1 of driving without due care and attention the hearing was set for Stratford magistrates court today.

Pretty much has to rate as one of the horriblest experiences of my life. Being in court facing van man and having his brief basically accuse me of lying. However the overwhelming evidence was coherently linked and substantiated most of my account.

I think van man did himself no favours for being late back for morning break, 45 minutes late back from lunch and in both instances nearly kicking off with the judge. However true to form he kicked off big time while he took the stand and effectively had a major rant and threatened me and accuse me of lying in front of the judge I had to leave the courtroom after that as it was too close to the experience he put me through in Jan 05.

Though he effectively admitted the driving charge and my assault while ranting.

Verdict: Guilty on all charges. Clear cut on my assault and the driving charge. They didn't find sufficient proof of Pensioner Pete being thumped, but him pushing Peter [again something he admitted to mid rant] was sufficient to find him guilty on the assault against Peter.

Sentencing is on 11th April.

Having sworn his oath on the Koran he proceeded to lie about what happened, then told me I will have to face Allah for this persecution of him and making up lies about him. Shame I couldn't have told him I'm an atheist

The good thing is that it has started to give me some closure about the whole thing and with his insurers admitting full liability and have paid up for the bike hopefully things will be a little easier this year than the past one has been for me.

Right I'm off to have bath, bottle of wine then bed. Will keep you updated as to the sentence. If he is lucky enough to escape a custodial sentence this time, he has since repeated the assault offence since and will be facing charges on those counts which given his previous, and this, should see him off the streets for a while.

So glad you posted this Lyn, and so glad too that the b*stard was found guilty - may they throw the book at him come sentencing.

Hopefully this is an omen that things are going to get a lot better, so now there's no need to be a stranger. Take care .

Glad to hear that he is hopefully going to get his comeuppance, lets hope he is kept off the roads and streets for a good length of time, enjoy your drink and bath.
