Default I am a wazzock!

had an accident a couple of weeks back, went into the back of a car.. totally my fault, was too close ( i know, i know). spoke to the bloke and we decided to settle privately...of course silly me didnt get a recipt etc
and today i get a call from my insurers telling me how he's made a claim, and that they're claiming personal injury and that the car was written off due to it being a low value vehicle.... (i hit it's rear bumper at about 15 mph...paint damage, no more)
insurance company is keeping me informed all the way, but if it all goes through looks like i'll have to sell the bike as i wont be able to afford the insurance when it comes up for renewal in november!

Then claim on your insurance for the damage to your vehicle, might as well as your premium will raise even if you don't.

Oh and have them check the vehicle because are you sure the brake lights etc were fully effective being as it's an aged vehicle?

If you have a couple of years NCB then check with your policy holder, a friend of mine *without* protected NCB only lost a year for the accident he declared. IIRC the first year is the most important at something like 30% the rest are 10%, 5% etc ...


Don't give up hope mate and definately don't sell the bike until you've explored all the avenues open to you.

TPFT insurance... one years no claims

i'll make sure to suggest an independant inspection when i speak to them again, thanks for the thought!
i'll keep my fingers crossed, and even if i do need to sell i'll be enjoying every last day i have left!

In that case don't forget to mention to your insurer that he requested it be done outside insurance. You of course were going to advise them of the claim come renewal time

Sorry to hear that... another good advert for always going through the insurers, no matter whose fault it was. Stick it into them and let them sort it out. There are some right scumbags out there who'll use any excuse to have a claim up on you, twice if they can get it... if you had any evidence of the payment then the guy could be done for insurance fraud (as he's claiming for something that's already fixed).

Possibly (assuming you have his number) give him a ring and let him know you passed his details on to the fraud squad as he's committing insurance fraud. Even if you have no evidence you may find the claim is withdrawn sharply OK so it's your word against his, but if a court did find him guilty of fraud, he's looking at jail, not a dent in his NCB...

amworking on the evidence for the payment, a bank statement showing a cash withdrawl from the location of the accident for the amount i have already disclosed and a potential witness...fingers crossed

Personally I would persue a claim for my damage and make the whole ssue very complicated. Unless he is a real prat he will get tied in knots as you claim the damage to your bike and let your insurance know that he settled before the claim.

I had a knobhead write off the wifes car and dent mine when he slid 50 yards into them whilst our cars were parked. He claimed it was my fault (?! - they were parked in marked bays and teh wife and I were watching The Bill at the time - go figure) He admitted fault at the scene (hard not to) and made several ofers to fix the cars. He then claimed on insurance and changed details etc. By the time I had let insurance know, and insisted on courtesy car, claimed structural damage to the neighbours house, mentioned the complaint to the police about the noise from his exhaust (rich from me I know!) etc the case got so confused he gave up!

That is good... maybe better to go straight to the police/insurers and try and get them to go after him? Be even better if they could trace some notes he still had to those you took out and he had no warning they were coming (I suspect I'm daydreaming here and they'd never expend that amount of CSI style work to somehting like this... )

Hope it's enough to at least scare him off, if it won't work out for real in court/detective work. A witness is worth their weight in gold... I was run into on my pushbike about 18 months ago and didn't think to get a witness... the cabbie who did it is still driving around and police and council say there's nothing they can do if it's just my word against his... though his insurers recently accepted he was 75% responsible... still waiting to see what that means... would have loved to get him busted (drove into me while turning off as he wasn't looking, then tried to drive off and a biker stopped him. I waited for weeks at the same spot at the same time trying to find 2 or 3 of the people that helped me and never saw any of them. Nasty experience and I've never gone on a pushbike since...)

As a last resort you have his address don't you?

I like your style... would never have thought about that sort of stuff... I guess when you're up against a wall like that you could cause some right havoc by putting in stuff like that. Nice!
