Default Crash Test Dummy - Me!

Well looks like I have finally lost my crashing motorbikes virginity!!!

Had a spill last Tuesday morning on my way to a course. Some dosy bint pulled out on me and although I managed to brake/swerve to avoid her I lost the bike and ended up with me and the bike sliding down the road. The road was wet but luckily I was only doing about 10-15 miles per hour.

I did walk away from it so I consider myself a very lucky boy!! Just sustained some minor injuries:

Both thumbs broken.
2 fingers broken.
Badly bruised hip
Killer headache for 2 days.
Worst of all bruised ego.

My already injured mediate ligament is also much worse since.......

The SV came off a bit better though:

Broken gear lever
Scarred clutch lever
Bent, but working radiator
Broken wing mirror
Broken front indictor
Minor fairing scuff

I also need a new lid as it smacked the floor quite hard and my water proofs have a few holes in the outer layer due to the slide.

Now the police say that I cannot claim as I didn't hit her, but she definitely caused the accident. That can't be right - can it?

that's ********, tell your insurers she caused it, although unless you have witnesses she'll say you just fell over and i doubt you'll win...

next time ride into her, then you have evidence

Sorry to hear this rubbish. Did she stop at all? Did you get any witnesses ? I think even the police will find it hard to believe you threw the bike downa straight road for fun

After my off 4 weeks ago, know how you feel, broke bone in my hand is just about bearable now, Bloke that puled out in front of me will pay for the damage but am having trouble getting the bits at the moment because he wants to keep it off the insurence, get your insurence to take it forward if you get 50-50 at least you'll get something back

There were witnesses, one of which was a biker, another a cyclist I cannot get their details from the police due to Data protection!!!

I'm only TPFT so cannot claim for any damage to my bike, but will my legal assist help?

I got a friend to do a Kwak style repair to the gear lever (bolt, two nuts and a bit of rubber pipe) so it can be riden. Then I am going to do the minimal amount to the bike until I can find out a bit more.

two bits of good news, if you have witnesses tell the police you're not happy that someone has causded an accident, make a huge scene if they try to fob you off, don't let it go

other bit is that if she caused the accident, her insurers pay for the damage to YOUR bike, because YOU are the 3rd party refered to on her insurance

AS TLW posted make a fuss to the police it was an accident and they are obliged to give you the other parties details if it was reported to them
