Default New can required - or I get an ASBO! (actually a Section 59 it now seems).

The local plod round where I work told me the neighbours arn't happy with my can! They reasonably suggested I fit an e marked can or they will give me a section 59 warning

So, anyone know if I can get such a can to fit the hindle full system I already have on it? It would not make sense to put the old pipes back just to cut them to fit a slip on. It's a 44.5 mm diameter. I was thinking that something in Titanium with a conical end cap would look good. Any ideas?

If it isn't e marked but doesn't have "not for road use" can they just penalise you without actually prosecuting you?

Is it stupidly loud or would it pass an MOT?

I would be tempted to get an MOT for it then advise the police that the can is within legal requirements and ask them to retract their threat of an ASBO.

They're going to issue with a Section 59 for a loud can Jeeze!

Just fit a baffle to it and tell the neighbours to STFU.

Afternoon sir!

I would echo the above, if the hindle can doesn't have "not for road use" written on it I'd fit a baffle, I drilled a small hole in my scorpion can to allow one to be bolted in.

Id be very careful.They have wide ranging powers to issue these asbos,because they dont need to actually prove anything like they would if they charged you with a crime.Its back door justice.They give you the asbo,then charge you with breaking the asbo conditions,which is a crime and can get you put inside.Im sure someone else can explain it better than me though????

It is NOT marked "not for road use".

It is stupidly loud, however, it did go through the MOT. Not even an advisory note.

I would normally just fit a baffle, cos it's miles cheaper and of course I can take it out easily.

However: The cop is local. He was within a whisker of giving me the ASBO. Only my understanding demeanour saved me. The deal is basically, if the neighbours complain again, he will issue it without even speaking to me or taking a look himself. So here's the rub - I don't know who complained. So, I can't know if whatever I fit is going to be enough. Having lived with noisy neighbours myself, I know that once you are sensitive, then you hear things more. If someone roars past their house on a blue bike, will they complain? Basically these asbos suck.

He and his sargent said "You must get it changed". If I park it nearby, and they see it, they may not see the baffle and just issue it anyway.

So, I figure I get a new can, and then at least I can say, "look, I did what you asked".

It's slightly annoying because no-one said anything before I got stopped by the cops.

how very annoying for you mate. I now one thing, the fact it passed an MOT sadly has no relevance to the cans legality or suitability to the road use.

If a cop says its too loud then its too loud

I would however be tempted to go to the station explain your above predicament re the can being a legal can, your intention to fit a baffle as your only real option and ask if you can have someone from their bike team inspect the can and give a second opinion or at least make a note that a baffle is not currently fitted. That way when you do fit one you can go back and get it signed off or approved or whatever by them.

Basically show them you are attempting to comply but wont go to the cost or trouble of replacing a legal item just cos one person says its too loud for their liking.

if you drove a Lambo or a GT40 would they be within their rights to demand you change your car to something quieter? Dont think so. So go down the road of "happy to comply and do all i can" but "not willing to spend my hard earned to replace something that is inherently legal to own and use".

That's just going to the extreme getting an ASBO for an exhaust pipe.

But you do get annoying neighbours, and asswipe local plod who just like to make anybody's life a misery....

I'd get a baffle put into the exhaust, go and see your local MOT centre to let them judge how loud it is after you put in the baffle, and then ask to see the sargeant who's threatening you with the asbo, to let him see what you've done, and it's fully legal... after that he can't do a thing to you regarding the asbo threat, and you can tell the annoying peace loving hippie neighbours that the bike is fully legit, and also to shove their moaning up their ****.... just don't rev the hell out out of the bike when you're close to them. Crawl away quietly to shut them up, then open up.

The neighbours can complain all they like, but as long as the bike is fully legit, there's not a thing the cops can do....you can complain to the cops about harrassment, get a badge no., and put in a formal complain to their superior officer. Makes them back right off...

Or complain to the cops about your annoying neighbours that you're still being harrassed after you've proved that you're doing nothing wrong.

Never back down on these issues, what they do to you, you do to them. Start a neighbour war
