Default Where do i stand

Now being young and naive i need your help please.
Ive got just some ally plates through in the post i got off ebay.
Now one is fine...the other not powdercoated, scratches, chips in paint and a completely different colour as its a hammerite rough finish.

Now the seller is getting back to me but is more suggesting as i wont see them theres no problem blah blah blah useual rubbish.
Anyways if i want the bad one replaced where do i stand and what can i do.
Or should i just lay it on the line and tell him i want it sorted or i put it in a dispute.

If the items are not as described them he is in breach and should replace with matching ones. if you are not happy then go to dispute if he won't put it right, but give him the chance to correct it first.

Daryl.

Yep telling me i now have to pay to send it back to him although it clearly says 7 day money back guarantee ....and i want a replacement not a return grrrrrrrrrrrr!

For a 2 identical items that: are different colours
differnent finishes ( one powerdcoated other not )
one damaged
one with paint chipping / missing

what are my chances of winning this as im really ****ing ****ed off at how his answers are just you wont notice the damage, and accusing me of trying to do a fast one on him although iv offered to send pics!

Mate, dont put up with it. No point telling us that his advert says 7 days guarantee. If he wont take the item back, give you a refund or replacement then you will dispute it.

Ebay is a legally binding contract therefore whatever he writes in his adverts, he has to work to it.

Does he have much feedback? 100%?

Feedback is pretty good but he denies his product is faulty although i have High quality photos.
If its binding then i have no issues just wanted to make sure he couldnt back his way out of giving me what i paid for.

Just tell him if he does not refund you, you will lodge a calim against him with Pay Pal and leave bad feedback regardless of the outcome. No seller likes bad feedback.

Seller rarely covers cost of postage & packing in these circumstances, the joys of mail order! Not sure what it is you've bought from them, or how much it cost, but I would also want the "rejected" item returned to me before I sent out a replacement. However, he/she should cover the cost of sending out the replacement.
