Default Write offs and scrapping of your own vehicle?

I'm after some advise if anyone can help?

I was knocked flat off my bike last year, and the bike's a Cat B write off. I've been told by my solicitor that I should now scrap the bike, and get whatever I can for it. Of course where the bike has been held it has incurred charges, but I'm rather keen to simply be no part of it, and let the 3rd party ins. sort it out. They don't want to.

Has anyone else been in this situ? I've got the cash, and the bike?!

a cat B must NOT go back on the road according to DVLA. surely this is now the responsibility of the insurers? doesn't answer your question, but in my case where my bike was a cat D write off, they offered compensation and would take the bike away. I opted to keep it, but the offer to remove without charge etc was available.

what does your solicitor advise?

Well they have advised it's up to me. But in all honesty, she's useless.

I'm getting the amount of charges now, and hopefully this will point me in the right direction. i.e Go nuts.

i wish i could charge for "advice" like that!! no wonder i have never met a poor solicitor!

i used a company called helphire to make my claim, i need to call them today anyway so i can ask their advice, hypothetically speaking. I'll post any useful comments.

I was in this situation 3 years ago, knocked off by third party, their assessor wrote the bike off as a Cat B, valued bike at £3000 and a salvage value of £116. Paid me £2884 and told me to dispose of bike, sold to a bike breakers for £650. Any cost for storage or recovery should be met by the third party insurers, keep receipts for everything, just remember that it is up to you to keep costs to a minimum, so any delay in disposing of the bike after they have said so, would be at your expense. Went through all this fiasco for the last three years, paid for the bike after 11 months, as a gesture of goodwill(!), then didn't settle the rest of the claim for a further 2 years. Worth it in the end, got £25,000!

The award was made up of lost earnings, damage to bike, damage to me and other "expenses". The damage to me was a badly broken ulna, radius and little finger, took about 5 operations to pin, plate and fix. All that accounted for about £10k, £3k for the bike, £500 for clothing helmet etc, the remaining £11.5k was loss of earnings, loss of promotion, loss of holidays. If you get a good solicitor and you can prove it, you can claim for anything! I got £2k because I was passed over for promotion whilst off recovering, another £1k because I had to cash in holiday pay and was unable to enjoy my holiday. As my solicitor said, if you provide a receipt or evidence then claim it!

If anyone needs a good accident solictor I can recommend Sherrington Law in Bolton, they do work nationally and work on deferred fee, or No Win/No Fee if you like.
