Default Recent police tug........... advise

Hi Everyone

Looking for your advice

Over the weekend I was stopped by the police (as were all bikes) on the A228 near Paddock Wood, Kent. They were looking for excessive noise exhausts and any other defects etc.

Unfortunatly for me a small number plate was noted and a £30 fine issued. In terms of my exhaust (remus GP, no baffles) the police stated that it was illegal due to not having a BS or EU stamp. Given a producer and a rectification slip.

This morning went to a garage to have the slip stamped as recitified to be told it is not a requirement of the vehicle inspetorate to have a BS/EU stamp and that the level of acceptable exhaust noise is one of personal conclusion or can be tested for DB emmissions, simply not having a BS/EU stamp should not be an offence.

Question, Who do you believe? any other experience of this or is it simply a great way to make some cash by pulling everyone to look for any minor infringments?

P.s they took a dim view of my iridium visor but felt I had had enough of a ticking off by now.

As you may have seen in another post the exhaust is for sale as seeing as I had to remove for the rectification slip I would see if there was any interest

I think you're out of luck on the numberplate issue, but I think your garage is right about the exhaust; the BS/EU stamp is not a requirement, as such.
It's all a bit complicated really, and the construction and use regulations are different to the MOT regs.
I won't give my interpretation of them, here, though, that would just confuse matters further, I think.

A road I know very well indeed... and travelled several times at the weekend - though I must admit I didn't notice any Rozzers.

It's worth noting that the cops are often out in that little region - following a lot of complaints from residents about noisy bikes.

Number plate they have got you on, as others have said the law on exhausts is confusing, Fraser01's post is worth a read

If I was you, I would pop my standard can back on get the rectification notice signed, got to police station with documents get that sorted and then put the remus back on again.

As for the Visor, well technically that is illegal to, but again IMHO is ridiculous, I have had darker sunglasses than my iridium visor, but its OK to wear them under a clear visor...

Kent Motorcycle Police, said at the bikesafe last year, that they have absolutely no argument with tinted visors on the road - simply because of the alternatives - sunglasses etc.

So I'm surprised that they mentioned your visor - I can only assume they weren't bike cops.

Cheers everyone

in responce to Billy, the location on Sunday was Five Oak Green, coming from Maidstone over the Hop farm round about, as you get to the next roundabout 2 police BMWs hidden in the gravel drive way on the left. Two police men standing on the roadside pulling all bikes time circa 10.30 am. Chap on a VTR with dual Akroprovic (not for road use) stamped getting a very hard time as he refuse to remove his lid!!!!!!!!!

not traffic but best plan is to replace your standard can for the vdrs slip, get your PG10 and well lets cover my **** here what you do with your non-legal can is up to you.

The law is sometimes such an **** even I get confused and give up!
but hey we're not all friendly

no luck with the fine you've got no argument there!

Visor I'd let you off!!

Thanks for that - know exactly where you mean!

It really should be the bikes doing this kind of stuff, as they know what they're talking about. But, Kent's Cheif is very anti-biking, having cut his Motorcycle unit by over 2/3rds!
