"and he is looking for the software to be upgraded to limit the iPod's sound output. "

Nice contradiction there. What if I have higher resistance 'phones (Sennheiser HD-25s, to be precise) and want it "louder" so I can actually hear the bloody thing? Idiot deserves any hearing loss he gets.

They won't win. It specifically says in the manual to not set it too loud.
If you can't understand that then you're the kind of person who needs it explaining that if you beat somebody repeatedly over the head with a baseball bat, then they may suffer head injuries.

This might be the same kind of guy that would:
- sue suzuki for not limiting their bikes' top speed to the lowest road imposed limit, on the basis that he could lose his license by having the possibility of going too fast;
- sue smith & wesson for making a gun with which you can injure yourself, say by looking down the barrel of a loaded gun to see if its clean, and pulling the trigger at the same time to check spring action;
- sue any cuttlery factory for producing items, namely kitchen knives, with which he can seriously injure himself, namely cut something right off his body or even stab himself;
- etc etc etc

Could this guy have anything to do with the w***ers that are trying to pass all those anti-piracy measures in the US, namely the liability issue? The one that states that if you produce any kind of software / hardware that can be used to defeat copy protection / allow file exchange, you can be charged for what your buyers do with it?

If you want to limit the Ipods output, either a) don't turn it up too loud or b) buy a headphone limiter.

Hearing loss will be a big problem in the near future. But suing the makers for your stupidity isn't the solution. And how exactly are they going to implement a limiter for every set of headphones out there?

BTW HD-25 good choice not cheap, but very nice.
