You can request that the police ask the cyclist if they mind having their details passed on to you. That decision lies with the cyclist, not the police.
The DPA does not prevent them from speaking to the cyclist about this.

Utter b0ll0xs about the '..because you didn't hit her, it's not her fault' malarky.. It was her lack of care and undue attention to the road that caused the accident in the first place. Get on the blower to the police and start quoting the highway code. My accident 5/6yrs ago sounds exactly like that. A guy pulls out in front of me from a side street and due to my evasive reaction, there was only one outcome and that was the pavement surfing option.

Keep at it, don't let it go otherwise you'll be the one paying for it all..

Luckily I managed to get a decent pay-out as the guy who caused my accident decided to do a runner whilst i was in the middle of the road thinking about the cost of replacement fairings..

FLM traing has been poor since before the accident, but it won't help. Going to leave it this week and try and start fresh next week.

I have just managed to speak to Carole Nash who are going to try and persue this using legal assist to reclaim all my costs. Makes me really glad I chose them over some of the cheaper options. They came up trumps for me previously in a car, so lets hope they can do it again.

I would say fingers crossed but that's not yet possible.

Thats who i was insured with and id deffo recommend their legal aid part! doing a good job with my accident claim so far.

I'm only TPFT so cannot claim for any damage to my bike, but will my legal assist help?
kral, this is ********! get onto rider support services and get a claim going. it sounds to me like the police are being lazy useless people who play with themselves on a daily basis. just because you didnt hit the car doesnt mean shes not at fault. get a claim going and put in a formal complaint against plod!

The good news:

Spoke to the solicitors earlier this afternoon, so Carole Nash didn't hang about on this, so that is in motion and quicker than I thought. It just proves that you get what you pay for.

The bad news:

One of the officers who attended the accident called me this evening as I have been trying to get the details with no joy. He again repeated that as far as they were concerned there were no other vehicles involved, even though the car caused my evasive action. He then said he couldn't give me the details due to this, when I asked for the witnesses names he again declined saying it was being passed to the traffic division who would decide what to do.

As a parting shot I asked for her reg number at the very least to which he replied 'I'll have to speak to my skipper and get back to you!'.

I'M STILL WAITING!!!!!!

Oh and one more nugget, he told me that the CAD number (not sure what that is) that I have and have been given by two seperate sources using my Reg no is incorrect and gave me a different one. WTF?

Does anyone know a) what is a CAD number? b) Can one incident have numerous CAD numbers? c) If so why?

Even moe bad news, I went for a check up at the hospital and I have another broken bone - the scaphoid, which is a smallish bone in your arm but as it has a particularly delicate blood supply can be nasty and the bone pften dies having to be removed by way of an operation.

I am now in plaster!
