i agree with the quote "why put your head in the lions mouth" i shouldnt have anything to do with it, a bit more info has made it sound like the lady is a stubborn old prune, should i just forget all about it and ignore it?

Yes just ignore it, she could have put your bike in a more 'contentious' position when she stood it back up again after knocking it over. I am assuming that someone else picked it up for her after creating the scratch, in which case she cannot prove where it was when she fell over it.

I have heard of police officers at least considering they have a good chance to claim from the insurance of a stolen car if they are injured by it. Whether the claim would stand is another question...


Don't forget to write down everything they have said. With the story changing and not stacking up with your knowledge (ambulance etc) I think they are trying to extort money from you therefore they can go forth and fornicate.

I would never put money on one of those either way. I've edited my previous post cause I can't remember which regulation the exceptions were under - RTA, MIB and European directives are all involved and all a bit different. You need to go on a training course to be able to read the manual that shows you how to use the flowchart. Total PITA but it keeps solicitors in work.

As for the issue at hand, if you say anything at all, say that you are sorry to hear that she had a fall and that you hope she is ok...end of.

If ca car door could be opened in the space between bike and road...how big is this woman that she had to squeeze past it?

I don't like the idea of elderly people falling over at night, but that is when family need to step in and help the person realise that maybe they can't still do certain things without being at risk. It isn't nice, but it is reality for all of us at some time.

The circumstances would be excluded by the policy but they're forced to pay under legislation. Although the insurers therefore have to pay a lot of claims they wouldn't otherwise be responsible for, the Road Traffic Act lets them claim their costs back from the policyholder.
