in other words ,he is trying to say that you "straight lined" the roundabout.
Unfortunatly ,it may look just like that.

Surely the damage to the front of his car, and back of yours shows that HE went into you?! I can see why you would be so annoyed. I'd be irate.

I know we want to support forum members, but we can't have it both ways!!

Hope you get it sorted by the way - without witnesses 50-50 my be your only option. Sucks.

The only clear unargueable position would have been to have stopped both cars immediately and get pics of where both cars were on the road, however without that I fear you may have to bit the bullet. The guy may be on another forum bemoaning the fact that you ran into him etc etc.

In an ideal world I could have done that but the incident was in the middle of the rather horrible roundabout just above the marker in this link:

Stopping there would have caused a bigger smash and I pulled in at the marker. Unfortunately he was the one who straightlined it. Rather than stay in the right hand lane of the roundabout onto right hand lane of the exit (as he should have done) he moved from the right hand lane on the roundabout to the left hand lane of the exit, which unfortunatly I was occupying it at the time.

I'm fully intending to fight this all the way as it will cost me my excess and no claims anyway if I dont, its just so frustrating that I could be significantly out of pocket for being in the correct lane minding my own business.

Wrong place wrong time, a court might not be too pleased that you "put your foot down" to make the gap I tried to use this to get out of a speeding ticket once. It was infact 100% true if I didnt put my foot down I'd have been sandwiched between a lorry and a wall, not a pleasent idea in a 106. They however only heard "put my foot down" and decided had I been a good motorist I'd have slowed to let the truck across. I know why you did it as I would (and have) done the same thing but in both cases we clearly made the wrong decision.

Definately wasn't the wrong decision, had I braked he would have still hit my front end and the car behind me would have been in my back seat.

Yeah you have a very good point. Never ever say that you accelerated or anything. Always remember, YOU were driving 100% in compliance with the rules of the road and doing nothing wrong. Never forget that and you should be ok.
