I got one of these from Camden Council last year and challenged it stating I wasn't there and could they produce any supporting evidence.

They stated that the Warden would have recorded the serial number of the Tax disc, so they could prove I was, however they later conceeded that he hadn't so withdrew the fine.

I did think it was odd that he had been in my house without my knowledge as that's where the Tax disc was

Just to clarify a few points here:
In order to issue a ticket lawfully a warden must place the ticket on the vehicle in question or in the hand of the owner otherwise, no ticket has been issued.

They do not need any more info or proof. Photos etc are not YET part of this law though they will be from next year I beleive. Tax Disk number is not always needed either.

When a ticket is contested and neither side back down, you will be asked to attend a hearing at the Appeals Office just above the Sports Cafe. They will provide their evidence and you provide yours plus any witness.....any witness will usually mean you get away with it...in fact, the nice woman that works on reception there said that over 80% of appeals go the drivers way. She even admited to being chased around a car park by a warden trying to give her a ticket...he didn't manage to get it on her car...she went to the board of appeal and it was thrown out.

It really does pay to fight these....BTW, this happened to Geek a while back but have heard nothing more....might be worth asking him!

I am wondering how you got a ticket on that date and nobody else did? or are they all going to get penalties in the post. Were you the only one there that week?

I got a ticket in July and appealed like mad (with photo evidence and an official disabled badge etc) but still had to give in and pay in the end. Not being able to walk is not even an excuse in Westminster.

If they can prove you were there then it's a bummer and youll have to pay but I really don't know what the outcome is if you say your not paying the late penalty as you never saw/got the ticket. Worth a letter asking for evidence at least. Might save you £50 or even £100, if not I'll buy you a drink at Xmas.

Thanks for the advice

I'm going to send a letter in stating the fact that I didn't receive a ticket and ask them to prove that they actually did issue it.

If admit to having witnesses does that incriminate me?

Good point Rob am I the only one to get a ticket?

Shall I bring the plastic bags on Friday?

I got a ticket in Westminster last year, forget the details as that is another issue, the point is, when I got back to my bike the ticket was "propped" on the handlebars and not secured to the bike in anyway. It would only have taken a gust of wind or some **** to remove the ticket and it would have cost me £100 and not the £50 that it actually did.

I contested the ticket but still had to pay in the end, but like I said that's another issue

this reminds me, I appealed but still had to pay the ticket while they reviewed the appeal, that was 3 months ago... think another letter is in order.

Sarj, mine was for June, and I never got the ticket, only the reminder saying I had to pay £100. I complained and have provided 2 witnesses to the fact I didnt see a warden or get a ticket on that night.

think I heard in the paper that Westminister have subcontracted out Traffic Wardens duties, but were reviewing it as they have had so many appeals/complaints.
