Yikes... sounds nasty. Good to hear you're OK if a bit bashed... could have been worse even at 20-30mph.

Although there might be a small element of the biker looking out for what other people are doing, the highway code states that (at least when parked - section 214) "you MUST ensure that you do not hit anyone when you open your door" - a legal requirement rather than just a guiding rule like most highway code stuff is.

The guy who did my DAS had a (parked) cabbie open his door on him when he was a bike courier and the irate cabbie called the police (having most of the door hanging off of the cab at that stage). Who then turned up and arrested the cabbie.

Have you spoken to the police? Get in touch with them ASAP - if the woman is arrested and/or sentenced, then that gives you a much better position. I think you need to tell them within 24 hours or something of it happening though.

Sorry to hear about your accident svpilot. I hope you heal very soon.

I too got caught up in all that traffic this morning. Its one thing looking out for drivers suddenly changing lanes but anticipating passengers opening their doors, thats something else.

Why the hell did she need to get out to check on them, a freelander is a 3-door, FFS!

I hope your witness backs you all the way on this.

Is 20-30ish too fast really, if the surrounding traffic is stationary? What do others here think?

How, in the name of all that is holy, can anyone attribute liability the biker when a passanger opens the door in the third lane!

My sympathy to the victim.
Hope that the pain soon fades, and the insurance pays up.

Do go to the police, for your own sake and hopefully so that one or two more people think before the do such stupid things.

for that road, that time of the morning, it depends. if the cars are apart and have left room for bikes then 20/25 is reasonable speed, especially if theres a few bikes going through. When its lorry/bus/4x4 attached to white line in one or both lane then its 5-10mph if not a complete crawl.

When people start changing lane I slow, due to the sheep syndrome. Others will follow presuming the person has changed lane for a good reason other than to move 2ft ahead

While it sounds fast in that kind of traffic, the reality is it really isnt. Next time youre filtering, check your speed. Bet you will be at least at 15-20pmh to make any progress.

I ride that road daily and while Ive seen most bikers anticipate lane changes, a passenger opening a door is just inconceivable. Theres only just enough room at times for bikes let alone open the door.
