As the publisher of the site, he is responsible for anything posted. At least he would be under English law, I assume it's the same in South Africa.

Say if the guy just made up this stuff, say it was untrue, sv650.org publisher is liable at this point? What happens to the guy who made the libelous statement? MrMagoo gets two settlements? It seems a bit mad. What stops them litigating against the ISP, or the manufacturers of the server on which the site runs? Why could they have some disclaimer saying all opinions are not those of the publisher etc.? Like they do on the bottom of those annoying emails. People write scandalous stuff on forums all the time. How come the lawyers arent roaming message boards in packs looking for this kind of thing? |
