It's hard to call - not enough info. in that story to know one way or the other. It's common for people to admit guilt in court over a RTA where someone has been killed. Courts like it and will tend to be more lenient when sentencing; nothing to do with whether they were guilty or not.

If the biker hadn't been killed, her legal and insurance people would have been baying for 50/50.

whatever the real cause, which none of us will ever know and can only speculate on, it makes a change for the court not to take the default position that a rider overtaking a car was in the wrong.

That's a very good point.

It also says that off duty cops and witnessess say the biker was fast but not excessive - but to cause broken ribs? It sounds to me that the car was using a traffic island to U turn. Islands do provide a pinch point in the road - not the best place to overtake?

None of us, I think, can say who is to blame, this is the trouble with not knowing the facts. Most important thing is that it raises vulnerability as a timely reminder for us all

May I say that although there is never a bright side to these tragic death's, at least she wasn't drunk, high, stolen or already banned as is normally the case.

They are the ones that should be locked up for at least manslaughter as they knowingly drive while not capable and although they "don't mean" to kill anyone they must realize it is a distinct possibility, and others seeing these cretins getting locked up for 15 years may make a difference.

We live in hope
