This consultation period business is a joke. They have to do it, else they get clobbered with a 'protective award' - ie, more compo. All they do is write a letter saying 'we wish to consult with you on possible ways forward' when what they really mean is 'we have decided to close down and to make all of you redundant'.
Do be sure that they follow a fair process - even if everyone is being made redundant they still have to write to you, invite you to a meeting, explain what they're doing, give you a chance to have your say, and then decide. If they don't follow the statutory process as a bare minimum, the dismissal is automatically unfair - even if had they followed a fair process the dismissal would have been fair - eg a redundancy. The BERR website is good on this. |

Agreed.
The unfair dismissal legislation is unreal.All about proceedure and nothing about justice or fairness.

My redundency is finalised so I will post the information about the final deal so that anyone else who faces the situation has some negotiating information.
My company was in manufacturing, it seems that generaly manufacturing deals are poor, but I dont think this was too bad. 1. Everyone regardless of service got 4 weeks notice, eventually paid in lieu. 2. Everyone got 3 weeks pay per years service (rounded up) 3. A termination payment was made in addition based on performance over the consultation period - paid per person a) £250 per week for full attendance that week b) £1000 payable if there were no accidents in the period c) £1000 payable for maintaining customer service d) £1000 payable if there was no damage or theft We also had some outplacement support (for the companies benifit to protect from potential compensation claims) Some individuals who elected for retraining got a grant towards the cost of up to £1000. For people with long service the was a cap on payment of £35000, this was renegotiated to £40,000 or 14 months pay, whichever was greater. (Only 3 people effected) In summary not too bad a deal I hope this information is of use to someone. |

With respect to Ed's post about unfair dismissal:
They were absolutly paranoid about this. They employed a consultant, at huge fee, to ensure the company was completly protected. This guy was a part time lay memeber of tribunals, and to be fair really knew his stuff. We found that the best way to get a movement during negotiations was to allude to unfairness, or adverse publicity. |

why oh why do people insist on doing this just before Christmas?!! happened to my brother last year as well - though at least it was the kick that he needed to start thinking about what he actually wanted to do

Seedy, sounds like you came off ok given its a bad situatin, least you'll be pocketing some money to see you through. Have you found some other avenue to go down? We're rootin' for ya
