Penalties are very harsh and you need deep pockets.

10.1Anyone who, in contravention of a TPO:

(1)cuts down, uproots or wilfully destroys a tree, or

(2)tops, lops or wilfully damages a tree in a way that is likely to destroy itis guilty of an offence.119 Anyone found guilty of this offence is liable, if convicted in the Magistrates Court, to a fine of up to £20,000. In serious cases a person may be committed for trial in the Crown Court and, if convicted, is liable to an unlimited fine.

10.2In determining the amount of any fine for this offence the Court must have regard to any financial benefit which has accrued, or is likely to accrue, in consequence of the offence.120

10.3It is also an offence for anyone to contravene the provisions of a TPO otherwise than as mentioned in paragraph 10.1 above.121 For example, anyone who lops a tree in contravention of a TPO, but in a way that the tree is not likely to be destroyed would be guilty of this offence (for the Courts interpretation of what is meant by 'destroyed' see paragraph 10.8 below). The penalty in this case is a fine in the Magistrates Court of up to £2,500. For this offence LPAs should note that the Magistrates Court cannot deal with a case unless the action is brought within six months from the time the offence was committed.122
Are you a tree hugger?

Have you thought that maybe he cant afford to get it done or isnt capable of doing it himself.

Have you actually tried offering to trim it for him or maybe helping out towards the cost of getting it done.

Call the Council and ask for the tree man, ask him if it's protected. He'll tell you over the phone.

Funny but the last tree man here in Shrewsbury emigrated to NZ cos the job was too stressful.

run round lots and give his tree a massive hug shouting "i love you". you'll either get done for trespassing or he'll get so pee'd of he'll cut it down himself

Make sure that there's no birds nesting in it either, or that can have you in bother too (depending on the species). For instance, our nextdoor neighbours said they were going to cut down a tree in their garden, until I pointed out it has a pair of Jays nesting in it, and the RSPB would be on them like a ton of bricks....

It could be that the bloke just is not able to prune it, either physically or economically.
