Bad luck mate. Before going ahead and informing your insurance company I would add up the cost of letting them know against the cost of damages, also the amount of time you are going to have to spend fighting it.

I had a similar accident and I contacted a few organisations for legal advice and I was told the best case scenario was 50:50 blame as I had no witnesses, the police although informed did not appear and I did not actually hit the car that pulled out on me.

As the blame would be 50:50, if I told my insurance company then that would raise my premiums for the next 5 years or so and as I only had TPFF I would still have to pay out for my repairs. I just couldn't be bothered fighting it all the way to the courts and so I decided not to to bother and just got my bike back on the road.

I'm not saying what you should do, but just to have a good think about it before going ahead. There is at least one thread on this forum somewhere about someone who innocently told their insurers about an accident, didn't claim but it still increased the premium substantially and it will continue to do so for the next few years.

Sorry to hear about your accident. Difficult one but good luck however you decide to proceed.

That is so sad.
I've already informed insurance company,so it's just to late.Just being naive,perhaps.
As I am in UK for about 7 months, my NCB is zero anyway.

nevermind! Accidents aren't all the same and mine would have come down to his word against mine and at the end of the day I didn't have too much damage to the bike and absolutely none to my kit.

From the sound of it, it will take a bit of money to get you back on the road so you haven't got anything to lose.

that is exactly what it was like. Cops did not come as nobody was hurt-that is what they said, but i gave them lady's details.
I didnt hit the car that caused my off a couple of years ago. I took a low side and the bike carried on into the car and me in front of it.

Luckily the reason he pulled across my lane out of a car park was to push into the traffic heading the other way so was stationary by the time i reached him.

i wish you all the best with your claim, im just saying hitting the car can make things alot easier, (i did say it wasnt a normal reaction though)...i tried to avoid the ar in both my accidents...but they tried to hard to hit me.

i suppose saying you were screwed was ever so slghtly harsh but you get the drift behind what im saying...itll be a long hard fight that will loose you time, sleep and possibly money (especially short term). Legal battles can take a long time.

Just be glad you werent hurt...easier said than done though mind

Andy

I had a similar accident except i actually got hit by the car involved. Car driver drove off, I got the police out and they seemed quite keen because of the hit and run nature of the incident. I literally had the cars number plate as it came off when he hit me.

So the police visited the registered address but were told that the they'd sold the car to someone who they didn't happen to get more than a first name off. I was only TPFT but the DAS got involved through my insurance company, only to reach the same conclusion as the police; they couldn't verify who was in posession of the car at the time, never mind who was driving it. End result: bugger all happened.

but that's only for injury if unidentified. If identified but uninsured than injury plus goods. But that's not either mine nor thegibdog's case.
Thats what I read in MCN some time ago.
