dont matter that he didnt intend to kill him the fact that he attacked an innocent man for no reason.
stupid actions often lead to tragic consequences.
lets say that this poor unfortunate man survived..the youth should have got 3 years just for attacking him

Agreed, but there was intent to hurt with the known possibility of it being more than a red cheek. The bottom line is this kids actions with the intent to hurt an innocent person resulted in a family being torn apart (I assume) and for that 3 years (18 months) really is not justice.

If I was the family I would be fuming/devastated.

Absolutely. The offence was recognised in the charge... I'm taking exception to the characterisation of it as "beating someone to death".

Of course there was intent to harm, I don't know what I said that could be read differently?

The boy didn't slap the guy in a childish and foolish way, he was trying to knock the bloke out and fractured his jaw in 2 places. That was intent to cause serious harm which I think would have deserved 3 years had the guy recovered. The fact his action of pure violence (not misguide pranking around or riding too quickly) took a life deserves a longer sentence. I just don't know how good custodian sentences are, surely the worse you are the easier it is to serve - mostly decent people would find going to prison a lot more intimidating than thugs. Maybe he should get a slap, or is that a punch?

We need tougher detterants. You've got make the criminals think that they can't get away with what they do easily. Its about time judges got in touch with reality and started treating criminals more harshly by handing down longer sentences and forget the idea of early release, make them do their full time given. no time off for good behaviour and all that cr*p cos they just come out early and start all over again.
