Legally you can't open the can, while it's legal to possess the can and legal to sell the opener your breaking the law when you open it I'm afraid

we had this conversation at work the other day (right and wrong) in some way or another we all do break the law whether its speeding, copying a DVD or CD, parking on a double yellow whilst you pop into the video store, jumping a red light, fitting a race can, a small number plate? i think you'll find we all do it in one way or another and if you believe in god its either right or wrong no in between

now i have open'd a can of worms

That's like saying you've murdered someone vs. nicked some batteries from the corner shop. Same difference - you broke a law. Only, it's not really is it?

Actually your argument is a little bit flawed. It is irrelevant if lukemillar has or hasn't copied to tape if he has bought the Cds in the first place.

What this thread was about was copying something when you haven't actually paid for a legal copy in the first place. THAT is illegal - making a personal copy of something you have paid for ISN'T. Provided you keep it personal and don't share it thats legally fine.

PS. I have 1885 mp3s and growing on my hard disk. And all of them are legal backups of my CDs that I can use if my damn cousin gets hold of any more of my CDs and scratches them to buggery again.

PPS If you think counterfeiting isnt a big deal, lets just hope you never get any counterfeited pharmaceuticals. These could have a serious impact on your health either by being completely ineffective or by containing dangerous ingredients. This is the problem, once you start saying counterfeiting is ok on one thing it gives licence for the counterfeiters to fake other things and it becomes a bigger issue. But I guess thats outside peoples considerations as long as it doesnt hurt them - until then its seemingly ok until that happens.

[Pedant] Actually that's still illegal too regardless of whether you own the cd or not http://www.ippr.org.uk/pressreleases/?id=2404 [/Pedant]

I stand corrected - but if you note the EU Copyright directive gives scope for this to be legislated into law allowing private use. And reality is provided Im not distributing these files or sharing them [which Im not] and I have the legal copy Im not going to get my door kicked in any time soon. Not when theres others here who have got stuff without ever having bought a copy in the first place. :P
