I fitted the baffle. It sounds crap now. Still noisy from the induction but quite a bit quieter when revved. I've parked the car park again. Fingers crossed that's enough!

Red Herring kindly provided the relevant sections of the legislation relating to Section 59 notices.
(a) contravenes section 3 or 34 of the Road Traffic Act 1988 (c. 52) (careless and inconsiderate driving and prohibition of off-road driving),

and

(b) is causing, or is likely to cause, alarm, distress or annoyance to members of the public,

If your local plod has another go at landing you with a Section 59 notice, be sure to get his details and ask him for details of the Section 3 or 34 offence he believes you to have committed. Note that this is a pre-requisite for a Section 59.

(Keep a printed copy of the relevant sections in your jacket pocket in case you need to refer to them).

Keep notes of his responses and if he persists, consider a written complaint to the senior office at his station.

Just my thoughts,

Keith.

Good morning all.

Good point there Trev. That's why we now have the size of a number plate as part of an MOT. It's thanks to all the idiots who had a plate the size of a fag packet mounted at a silly angle.
Have you spared a thought for your neighbours? They may have childern asleep, & you may be riding past at an un-social hour & so on.
Whether you agree with the local plod or not, you have by your own admission got a bike that's excessively loud. You've had a warning, so either change your can or get a baffle.

Cheers.

Yeah ok............so perhaps we should all stop speaking in case we say the wrong thing, doing DIY in case it annoys the neighbours, walking down the road in case someone objects to what we wear, breathing in case we inadvertently give someone a cold......etc etc etc etc............whatever happened to live and let live?

PS my local bus is very noisy when it stops at the stop outside my house, then the air brakes whoosh........perhaps I'll complain

Try reading ALL the posts in the thread or, at the very least, the last page. If you had bothered to read the last page you would have seen that Thor has put a baffle in.

Yes I have, and it sucks.

What I found annoying was that no-one said anything to me, until the police pounced. I still don't know who complained, so I can't ask them if the baffle is sufficient. A quick word or note and I could pop round, say hi, show them the baffle and give them a bottle of wine or something to say sorry. The way this has worked out it is impossible for me to show the neighbourly love, so to speak. I tried calling the copper to pass on the message but he never called me back - presumably he has (quite rightly) better things to do.

I used to live next door to an elderly couple. I used to drop in from time to time and they said they liked the noise because they knew it was me and it gave some life to their day! If I had not gone round, then I would just have been "that hooligan on his bike". Same can, same noise, totally different outcome.

Oh well!

I'm all for live & let live, but with consideration for others too. I'm sure if you're neighbours started doing DIY at midnight you would have something to say, would you not?
I take it the bus stop was outside your house when you moved in, did you think it was there for decoration? Did it not occur to you that buses might actually stop there.

Bellerphon, I did read the whole section, & I was merely expressing my opinion. No NEED TO PUT THINGS IN CAPITALS!!!!

Cheers.

Thor...anyone who knows you knows you're a nice guy and very chilled and relaxed with it.

Its a crying shame your neighbours didnt approach you about this directly to find this out for themselves.

But you have now done all that i would do and that is reasonable to expect of you i'd say. However, i know from experience of dealing with cops that you need to have everything in writting for them to accept it, otherwise its their word over yours and their word will win every time.

Not suggesting you write to them but keep a written log of all that has happened with dates and times and shoulder numbers of officers you deal with, so whould it come to it and they still decide to slap you with a 59, you at least ahve something usefull to be able to appeal it with.

You say about the cop aint called you back cos he probably has better things to do....well you were one of those better things one day so its the least he can do to follow it up when you are being proactive about i. I'd call several more times and get a bit snotty about him not calling you back too. After all its not for him to bark threats at you and then not look to see what you have done to comply with his instructions.
