N.I.P. Question?

It's now exactly six months since I was stopped on the M8 for speeding and verbally notified that I may be prosecuted.

Since then I've heard nothing.

I've heard various suggestions that they have either 6 months or 9 months to start a prosecution for the offence from the date they verbally give me my NIP.

I'd be shocked if I'd somehow managed to slip through the net, but can anyone confirm what the situations is.

Incidentally the bike and my license have been register to me at my address for a number of years so it's not a case of going to someone else.

From what I understand, they have 3 weeks to notify you.

At six months, I'd have thought you'd be in the clear now.

He's already been notified at the side of the road. The issue is how long they have to actually start the proceedings.

Correct - sort of.

They have 6 months in which to lay the information before the Court.

It is the Court that sends out the Summons and this can be months after the information is laid. Sorry, that celebratory pint will have to wait for bit.

Now that the six months is up, it might be wise to write to the Chief Constable asking if you are being prosecuted or not.

So, do you know if there's a time limit on how long the court takes to notify me and would Scots courts differ from those in E&W?

Hmmmmm, least said, soonest mended me thinks!

..... but is there any way I can find out if papers have been laid before the court other than asking the police?

Courts in Scotland differ to those in E&W........

Normal procedure is that you get a verbal NIP at the road side and then the police have 6 months from then to bring about a prosecution.

If you aint heard anything then keep your mouth shut and quietly exit through the side door........

In E & W, you could ask the Clerk of the Court - ring them up or just wander in someone should help. It'll be the court nearest to where the (alleged) offence took place.

Isn't it true that after the verbal NIP, if you say “I do not recognise the significance of those words and I would like to exercise my legal right to refer to PACE – The Police and Criminal Evidence Act”.

Then you can legally waste hours of police time by reading a huge document in the back of the cop car?
