Default Bailiff letter

Need some help from a legal point of view.

I think i read a letter draft (possibly on here) on what to do if you get incorrect debt collections sent to you. Almost the right name, but wrong date of birth when speaking to them, and the credit card mentioned was never taken out.

I assume its coming from a company gone under and the pople going through the mess are chasing up old debts, and just mailing people with the same/similar name. However they will not stop sending letters.

I read a draft stating about further replies will be charged etc and this is the wrong person etc but i cant seem to find it now.

any help would be much appreciated.

Contact the CAB, they are used to dealing with this sort of thing. Other options may be the financial Ombudsman for advice in dealing with a company who have you listed for something that you have not done.

Might be worth doing a quick credit check on yourself, couple of quid with Experian, can be done on-line, just to make sure someone hasn't done an id thaft on you and is running up debt against your name.

Check your credit report.

Call the CAB and discuss.

Write a letter to the company sending you reminders/demands for payment and state in it how many letters you have recieved, how many times you have called to rectify the situation and what, if anything you have been told by them. Ask them to please get in contact with you (don't give telephone numbers) by mail if they require proof of your identity in order to remove your records from the system.

Don't give them a timeline...this can help them. Instead, send the letter by recorded delivery and keep the reciept as proof of the date.

If, after 8 weeks, they haven't concluded the case to your satisfaction, get straight on the phone to the Financial Ombudsman, tell them it has been 8 weeks since they had the letter and have failed to take satisfactory action. The Ombudsman will be able to intervene at this point. They'll send out a form for you to fill in and return and they will then take over.

HTH, but speak to the CAB first as it may have changed since I had to do it.

I've been contacted by a debt collecting company a few times about two things:
- someone cloned my card details and used it (not) to pay his electricity bills in Glasgow,
- the previous tenant of my flat didn't pay his bills and they started contacting me (does my name sound like Claire??).

I wrote 1 letter to them, said everything, after that I got another 2-3 calls asking about a Claire xxx, but all went quiet for the last 18months or so.

I got chased by T-mobile last year for £70 odd that they apparently thought i owed them. turned out loads of peeps got this letter as T-mobile had sold all their debts to a new collections company.

knowing this and the fact that T-mobile had agreed to wipe this final chanrge from my bill as i was leaving them after major hassles with them i decided to do the best thing...and shred the letter, lol.

I know they have thousands of customers who i'm sure owe them far more than i did (not that i did owe it) and that if they didnt get a response from me they'd deal with the ones they got a response from first knowing they were writing to the correct address etc by virtue of peeps calling or writing back to them.

T-mobile, biggest bunch of shiesters i have ever encountered!

thanks for the advice guys, its not for me, for a friend. I think its just a mistaken identity thing, so hopefully wont be too much of an issue
